A defendant shall be punished by imprisonment for not less than eight months.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
On November 15, 2011, the Defendant was sentenced to imprisonment with prison labor for six months at the Seoul Southern District Court for fraud, etc., and the said judgment became final and conclusive on the 23th of the same month.
1. On June 9, 2010, the Defendant, in collusion with D and E, had the intent to forge the Defendant’s resident registration certificate with respect to F and forged the loan fraud. Around June 9, 2010, D had the Defendant’s photograph printed and F resident registration number informed E of the Defendant’s photograph and F resident registration number on the 10th of the same month and asked E to forge the F’s resident registration certificate, and E received it, and issued to D at the calendar on June 13, 2010 by forging the F’s resident registration certificate in an irregular manner.
Accordingly, the Defendant forged the F resident registration certificate under the name of the head of Mapo-gu Office, an official document, for the purpose of uttering in collusion with D, etc.
2. On June 17, 2010, the Defendant: (a) conspired with D in collusion with D to borrow money from credit service providers G; (b) on the indication column of real estate in the “fact confirmation sheet”; (c) on the confirmation column, the Defendant stated “F” as “YY H202”; and (d) affixed D’s seal on the F’s name and affixed D’s name in advance at the same date, time, place, and place, stating “Lease letter” as “F H202,” stating “F,” stating that D’s name was “F, J, Songpa-gu Building 75, and 103, and then affixed F’s name and joint signature at the same place, 30,000,000,000 affiliated with D’s name and joint signature at the same time and place, 5,000,000,000 affiliated with D’s name and joint signature at the same time and place, 5,000,000.
Accordingly, the defendant is about the rights and obligations without authority for the purpose of exercising them in collusion with D.
