A defendant shall be punished by imprisonment for six months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

The defendant, as the representative of the C Company and D Company in Tong Young-si, is an employer who runs the vessel rental and processing business.

The Defendant, while working in the pertinent workplace from April 30, 2012 to May 8, 2012, did not pay KRW 633,260 to retired workers E within 14 days from the date of his/her retirement without an agreement on extension of the due date between the parties concerned.

In addition, the Defendant did not pay 86,614,506 won for 24 employees of the company as well as 15,167,690 won for retirement allowances for 8 employees, 101,782,196 won for 14 days from the date of retirement without agreement between the parties on the extension of the due date.
