Defendants shall be punished by imprisonment for one year and six months.

However, for two years from the date this judgment becomes final and conclusive, each of the above punishments shall be executed.

Defendant

A, Chinese nationality, entered Korea on August 23, 2008, and around February 2013, is a university student scheduled to graduate from E University Agricultural Bioscience University landscaping course. Defendant B, Chinese nationality, entered Korea on August 14, 201, is a university student attending the E University Social Science University political diplomacy course.

피고인들은 F 등 일행들과 함께 2012. 12. 16. 01:00경 대구 북구 G에 있는 ‘H’라는 주점에서 다른 테이블에서 술을 마시던 피해자 I(24세), J(24세)이 함께 피고인들이 술을 마시던 테이블 옆을 지나가던 중 피해자 I가 “눈까리 깔아, 이 새끼야”라고 욕설을 하자, 이에 화가 난 피고인 A는 자리에서 일어나 피해자들에게 “개새끼, 뭐라고 했나”라고 욕설을 하면서 테이블 위에 있던 위험한 물건인 유리로 된 300CC 맥주컵을 집어 들고 피해자 J의 얼굴에 집어던져 입술을 터지게 하고, 손바닥으로 피해자 I의 얼굴 부위를 1회 때리고, 피고인 B는 테이블 위에 있던 위험한 물건인 유리로 된 맥주컵을 집어 들고 피해자 J의 뒤통수 부위에 던져 뒷머리부분을 찢어지게 하고, F는 피해자 I의 배 부위를 발로 1회 찼다.

As a result, the Defendants carried dangerous articles jointly with F and inflicted injury on the victim J for about 21 days in need of medical treatment, open wound in the mouth part, and assaulted the victim I.
