The judgment below
Part concerning Defendant A and B shall be reversed, respectively.
Defendant
A, Defendant B, who was sentenced to imprisonment of one year and two months.
Reasons
1. Summary of grounds for appeal;
A. The lower court’s punishment against the Defendants (one year and six months of imprisonment) is too unreasonable.
B. The lower court’s sentence against the Defendants on the prosecutor is too unhued and unreasonable.
2. The Defendant A, B, and the Prosecutor’s above Defendants committed a scaming crime on the grounds of appeal against the said Defendants in a systematic and planned manner against many unspecified victims, and it is highly necessary to punish them strictly. The Defendants actively take part in the crime, such as misrepresentation of prosecution investigators and deceiving people, and thus, are not less responsible for such crime. The damages caused by the instant crime have not yet been completely recovered, and the victims who did not agree want to punish the Defendants are disadvantageous to the Defendants.
On the other hand, the defendants should not repeat again when they violate their mistakes. The period of the defendants' crime is relatively short, and the defendants actively cooperate in the criminal investigation after voluntarily withdrawing from the criminal organization, and some defendants do not want the punishment of the defendants, and they do not have any history of punishment for the same kind of crime, and Defendant B does not have to consider equity with the case where the judgment is rendered simultaneously with the crime for which judgment has become final and conclusive.
In addition, in full view of all the sentencing factors shown in the records and arguments of this case, such as the age, character, conduct and environment of the Defendants, motive, means and consequence of the crimes, the circumstances after the crimes, etc., the lower court's punishment against the Defendants is somewhat inappropriate.
Therefore, the defendants' assertion is justified, and the prosecutor's assertion is without merit.
