Reasons
Punishment of the crime
The defendant is the representative director of Corporation D (hereinafter referred to as "D") located in Gwangju Mine-gu C.
D is an enterprise that supplies parts to the Korea Water and Atomic Energy Co., Ltd. (hereinafter referred to as the “Korea Water and Resources”), and when the parts designated as safety grade (T, R, and S 4) or safety impact grade (T, R, or Class A, which would directly or indirectly cause radiation hazards to the general public in the event of a malfunction or defect, have been first classified into Q, T, R, and S 4, but T, R is integrated into Category A, and T, for Q, A, and S 3) have been supplied to Korea Water and Resources, it shall submit a test report approved by the State to issue a test report (or issue company).
1. Forgery of private documents and the display of private documents;
A. On March 17, 2009, the Defendant, on March 17, 2009, requested the Korea Chemical Testing and Research Institute to issue a test report to the Korea Institute in order to supply at the Qclass nuclear power plant of Q class Qacker 8, a nuclear power plant of the Q class, which entered into a supply contract (contract No. E) with the Korea Atomic Power Headquarters on March 17, 2009, but the said parts failed to meet the ASM standard, which is the supply standard for the Korea-U.S. water source. As the result indicated in the above test report, the Defendant attempted to induce the supply of the said parts by deceiving Hanwon as if the results indicated in the above test report meet the above criteria.
On May 18, 2009, the Defendant posted the number printed as “373” on the test item “473” on the test item “473”, which is the result of the test item “satisfying strength” among the test report issued by the Korea Chemical Testing and Research Institute, at D office around May 18, 2009, and affixed the number printed as “41” on the “51”, which is the result of the smoke rate, and forged one copy of the test report in the name of the president of the Korea Chemical Testing and Research Institute, which is a private document concerning a certificate of fact, for the purpose of exercising the certificate, and around May 25, 2009, the Defendant forged one copy of the test report in the name of the president of the Korea Chemical Testing and Research Institute.
