1. The Defendants: KRW 51,900,000 for each Plaintiff and 5% per annum from April 11, 2013 to March 27, 2014.
Reasons
1. Facts of recognition;
A. Defendant B is a licensed real estate agent who runs real estate brokerage business under the trade name of “D Licensed Real Estate Agent Office” on the first floor of Suwon-si Office, and the Defendant Association is a mutual aid business entity which entered into a mutual aid agreement with Defendant B, a member of which the Plaintiff Association, on the ground that the deduction amount is KRW 100,000,000, and the deduction period is from May 6, 2010 to May 5, 2011, Defendant B caused property damage to a transaction party due to intentional or negligent conduct of real estate brokerage.
B. The building indicated in the separate sheet (hereinafter “instant building”) was originally owned by the Overseas Telecom Co., Ltd. (hereinafter “Nonindicted Company”) and completed the registration of ownership transfer of the instant building on March 18, 2010, and the registration of ownership transfer was completed on January 18, 201 under the name of the Asian Trust Co., Ltd. (hereinafter “A Trust”) for the same date (hereinafter “instant trust agreement”).
The main contents of the instant trust agreement concerning the instant case are as follows.
The non-party company (hereinafter referred to as the "trustee") has entrusted the instant building and its site (hereinafter referred to as the "trust real estate") to the Asian Trust (hereinafter referred to as the "trustee") and the trustee has entered into a real estate security trust contract (hereinafter referred to as the "trust contract") as follows in accepting the trust.
Article 1 (Trust Purpose) In order to ensure the management of ownership of real estate held in a trust and the performance of obligations or responsibilities to be borne by the truster (including the debtor, if any; hereinafter the same shall apply) or liabilities, the trustee shall preserve and manage the real estate held in a trust and settle the settlement of the settlement of
