Reasons
1. Basic facts
A. 1) Construction of the instant building (hereinafter “instant construction”)
Defendant C and contractor Co., Ltd. (hereinafter referred to as “Integrated Construction”) with respect to the orderee
() From November 9, 2010 to May 9, 2011, if the cost of construction is 2,030,000,000 won (if the value-added tax is not included or not included in an amount including value-added tax, value-added tax is not included, value-added tax shall be omitted.
2) As of November 10, 2010, the construction agreement was drawn up on November 10, 2010. 2) The construction agreement was drawn up on November 10, 2010 with the contractor, Defendant B, the contractor, and the construction cost as KRW 1,850,000 with respect to the instant construction project.
B. 1) As to the instant construction, the Plaintiff’s contract was drafted on November 23, 2010, on the supply of steel as of November 24, 201 with the supplier, a person who is supplied with a comprehensive construction by adding steel, and the amount of goods at KRW 202,80,00. 2) The Plaintiff’s contract was drafted on the supply of steel at KRW 145,15,043 from November 24, 201 to April 1, 201 and was paid KRW 35,585,380 from the integrated construction from December 22, 2010 to June 10, 201.
C. 1) Of the instant construction works, a contractor, the subcontractor, the Plaintiff Hoil Industry from February 25, 201 to April 25, 2011, the construction period of which was KRW 86,000,000, was drafted by the construction subcontract agreement on February 15, 2011. The Plaintiff Hoil Industry completed the said metal creative work on April 201 (the Plaintiff Hoil Industry was composed of an additional amount of KRW 11,00,000,000 while the said metal creative work was being performed (On the other hand, the total construction cost was KRW 97,00,000,000) and the total construction cost was paid from the total construction from June 2, 201 to June 8, 2011, KRW 30,000,000.
