피고인은 관할 관청에 신고하지 아니하고 2012. 11. 7.경부터 2013. 1. 9.경까지 서울 동작구 B에서 'C’라는 상호의 음식점 내에서 식탁 2개, 냉장고 1대, 싱크대, 조리기구 등을 갖추고 손님들을 상대로 떡볶이, 어묵, 튀김을 조리ㆍ판매하여 하루 평균 3만 원 상당의 매상을 올리는 일반음식점 영업을 하였다.
