A defendant shall be punished by imprisonment for not less than three months.

Punishment of the crime

On July 17, 2014, the Defendant was sentenced to two years of imprisonment for fraud in the Daegu District Court Kimcheon Branch, and the judgment became final and conclusive on the 25th of the same month.

1. Around April 2009, the Defendant made a false statement to the effect that, at a restaurant operated by the victim E in the soup Doesae-gun, Chungcheongnam-gun, Chungcheongnam-gun, Chungcheongnam-do around early April 2009, the Defendant would sell 15 million won and repaid the principal and pay interest for each month by selling it.”

However, in fact, the Defendant was in a bad credit position amounting to KRW 80 million at the time, and was engaged in daily wholesale business, but there was almost no income from the payment of living expenses, etc., and was trying to use the money borrowed from the victim as his/her own debt, living expenses, etc.

As above, the Defendant, by deceiving the victim, received KRW 15 million from the victim to the Agricultural Cooperative Account under the name of the Defendant for the purpose of borrowing money.

2. Around May 2009, the Defendant stated that “Around May 2009, the Defendant provided that “Around May 2009, the Defendant had a good business operation, and the Defendant borrowed Hashed money to purchase a dry field more among yellows.”

However, in fact, the Defendant did not have purchased a dry field, and was in excess of the obligation as above, and thus was trying to use the borrowed money from the victim as his/her own debt, living expenses, etc.

As above, the defendant deceivings the victim as above, and 6 million won from the 15th of the same month to the Agricultural Cooperative Account under the name of the defendant for the purpose of borrowing money from the victim, and the same year.

6. 1.5 million won in the around December 19, 200 won in the 19th day of the same month, 1.5 million won in the 26th day of the same month, and 1. million won in the same year.

7. From 16. Around 17.0 million won, a total of 2,1.2 million won was remitted, respectively.
