Reasons
Punishment of the crime
On May 14, 2015, the Defendant entered into a sales contract with Seongbuk-gu E site and commercial building located in Seongbuk-gu, Sungnam-gu, Seoul, with a total of KRW 4.1 billion between D and D.
The Defendant registered as a rental business operator and received bank loans with the above land and buildings as collateral, and subsequently, intended to reduce transfer income tax at the time of selling the above land and buildings, the Defendant prepared a so-called business-up contract with the sales price of 4.9 billion won in total without obtaining the above D’s consent, and intended to submit it to the tax office.
1. On May 27, 2015, the Defendant forged private documents: (a) at the G Authorized Broker Office located in Seongbuk-gu, Seongbuk-gu, Sungnam-gu, Seoul, by using a computer in the column where the land for real estate sale and purchase is indicated; (b) in the column where the land for real estate transaction is indicated, “Seoul-gu, Sungnam-gu, Incheon; (c)” in the area column; (d) “315.9 square meters”; (e)” in the structure column; (e) “the steel reinforced concrete structure”; (e) “the KRW 490,00,000 (Won )”; (e)” in the contract deposit column; (e) “the KRW 300,000,000,000,000,000,000,000,000,000,” and (e) on May 11, 2015; and (e) the seller’s name “Seoul-do,” signing-do’s name.
Accordingly, for the purpose of exercising rights and obligations, the Defendant forged a copy of the real estate sale contract in the name of D.
2. On May 28, 2015, the Defendant: (a) filed an application for the registration of a business operator in the Sungnam Tax Office located in the name of the Defendant at the Sungnam Tax Office, which wishes to revise the Sungnam City, around 480; and (b) held the forged commercial building agreement as if it was duly formed with a public official in the name of the said tax office who was aware of the forged fact.
