A defendant shall be punished by imprisonment for two years.

However, the execution of the above punishment shall be suspended for three years from the date this judgment becomes final and conclusive.

Punishment of the crime

[Criminal Power] On December 14, 2018, the Defendant was issued a summary order of KRW 1.5 million by the Suwon District Court for the crime of violation of the Road Traffic Act.

【Criminal Facts】

1. On December 18, 2019, the Defendant violated the Act on the Aggravated Punishment, etc. of Specific Crimes (Bodily Injury resulting from Dangerous Driving) driving a passenger car with B blood alcohol concentration of 0.180%, and driving ben E220 cars with a view to driving 405 km points in the Gannan-gu, Sungnam-si, Sungnam-si, in the middle of three-lanes and four-lanes among the five-lanes in Seoul TTS.

At the time of night and there are many vehicles on the front side, so there were duty of care to look at the front side and the left side and the right side of the vehicle driver, to accurately operate the steering system, to adjust the speed in advance, and to proceed safely.

Nevertheless, the Defendant neglected this and went along three lanes due to the negligence of driving the victim C(31 years old) with three lanes due to the negligence of driving it, and continued to turn the back part of the victim C(31 years old)'s driving car into the front part of the above benz's driving seat, and the above benz car was driven by the victim E(48 years old) driving, which continued to go along four lanes due to its shock.

As a result, the Defendant driven the said benz car in a situation where normal driving is difficult due to influence of drinking, and suffered injury to the victim C, such as salt ties, etc. in need of a three-day medical treatment, and injury to the victim E, such as in need of a two-day medical treatment, and suffered injury to the victim G (the age of 40) who was on the said scke car for about two-day medical treatment.

2. A defendant who violates the Road Traffic Act shall have the record of violating the prohibition on drinking and driving under paragraph (1) at the place specified in paragraph (1) from the place where the Songpa-gu Seoul Metropolitan Government is not more than scambling-dong.
