1. 공소사실 피고인은 2014. 2. 9. 경 파주시 B 2 층에서, 피고인의 PC를 이용하여 일간 베스트 저장소 (www .libe .com )에 ‘C’ 라는 제목의 피해자 D이 촬영된 동영상 ‘ 묻지 마, 보지 마, 말하지 마, D, 외대학생기자’ 게시물에 ‘ 똥고 애 꼬추꼽아서 비명 지를 때 고기 돌려서 혓바닥 땡겨서 침 뱉어서 먹여 주소 싶당

’, ‘ 꼬추로 목구멍까지 쑤셔서 숨막혀 컥컥 거릴 때 찐하게 입사한 다음 코로 정액 역류시켜서 코로 정액 풍선 불게 만들고 싶다’ 라는 댓 글을 게시하여 피해자를 공연히 모욕하였다.

2. The facts charged in the instant case are crimes falling under Article 311 of the Criminal Act, and can be prosecuted only upon a complaint under Article 312(1) of the Criminal Act.

In this regard, the victim revoked the complaint against the defendant around August 8, 2016, which was after the prosecution of this case.

Therefore, the prosecution against this part is dismissed in accordance with Article 327 subparagraph 5 of the Criminal Procedure Act.
