Defendants are not guilty. The summary of this judgment is publicly announced.
Reasons
1. The summary of the facts charged against Defendant A of the 2016 High 979, who is the representative of the E Saemaul Bank located in Busan Shipping Daegu D, and is engaged in financial business with 12 full-time workers.
Wages shall be paid in full directly to workers in currency.
Provided, That where there are special provisions in Acts and subordinate statutes or an organization agreement, part of the wages may be deducted or paid by means other than currency.
Nevertheless, Defendant A did not pay 5,811,350 won to 11 employees, such as the above F, on March 2015, 2015, or September 2015 (basic pay, salary class, job allowances, overtime allowances, weather allowances, physical training allowances, annual salary), 4,130,330 won, as stated in the group agreement and wage agreement, from March 2015 to September 2015, as well as the money and valuables in arrears for each individual in attached Table 1, to 11 employees, including F, etc., on the 20th day of each month, which is the regular payment day.
Defendant A, “2017 High 342,” is an employer who carries on financial business using 12 full-time workers, from February 23, 2015 to April 8, 2016; Defendant B, from October 5, 2015 to November 4, 2015; Defendant C, from April 9, 2016 to May 4, 2016; and Defendant C, from May 5, 2016 to May 5, 2016, using 12 full-time workers.
Wages shall be paid in full directly to workers in currency.
Provided, That where there are special provisions in Acts and subordinate statutes or an organization agreement, part of the wages may be deducted or paid by means other than currency.
A. Defendant A, despite the fact that Defendant A did not pay KRW 3,139,290 on November 201, 2015 to the employees F employed in the said workplace from March 2016 to March 12, 2016, and Defendant A did not pay KRW 45,442,980 in total on the 20th of each month, which is the date of the regular payment of wages, to 12 persons, such as the above F, etc., as in the statement of money in arrears in the attached Form.
