1. The Plaintiff among the distribution schedule prepared on November 27, 2014 by the said court with respect to the Ulsan District Court C’s auction of real estate.

1. Basic facts

A. From October 2, 1995 to July 31, 2013, Plaintiff A served as a street cleaners at a marina hospital established under the Non-Party Medical Center, the East Medical Foundation (hereinafter “Non-Party Foundation”), and Plaintiff B served as a caregiver at the above hospital from November 1, 2012 to November 6, 2013.

B. Around 2013, the auction process of real estate was conducted with respect to the land and its ground buildings, etc. owned by the non-party foundation in Gyeyang-si, Yangsan-dong, 989-3 (hereinafter “instant real estate”).

(Ulsan District Court C; hereinafter referred to as the auction of this case).

Plaintiff

(1) Until October 2010, Plaintiff A did not receive the total of KRW 5,108,488, retirement allowances and retirement allowances of KRW 26,32,380 from Non-Party Foundation, and KRW 31,430,868 from Non-Party A until October 2010.

(2) On October 26, 2010, Plaintiff A received 8,412,060 won as substitute payment from the Employment and Labor Agency for the last three months of the unpaid wages and retirement allowances, as well as retirement allowances for the last three years.

(3) On or before March 3, 2014, Plaintiff A submitted to the auction court of the instant case a written demand for distribution, seeking a distribution of the remaining wages and retirement allowances totaling KRW 23,018,808 (= KRW 31,430,868 – KRW 8,412,060).

The letter of demand for distribution is accompanied by the confirmation of overdue money and valuables issued by the head of the Busan Regional Employment and Labor Office and the confirmation document of payment of national health insurance premiums issued by the National Health Insurance Corporation.

Plaintiff

B’s demand for distribution, etc. (1) Plaintiff B did not receive KRW 2,965,481 from Nonparty Foundation, in total, KRW 1,608,456 from October 2013 to November 6, 2013.

(2) The Plaintiff B submitted to the instant auction court a letter of demand for distribution seeking the distribution of the accrued wages and retirement allowances prior to the completion date of demand for distribution.

In the above demand for distribution, the details of the arrears described in paragraph (1) shall be stated.
