A defendant shall be punished by imprisonment for six months.

Punishment of the crime

1. Around June 23, 2011, the Defendant made a false statement to the victim D that “The Defendant would buy and use continuously the cosmetics he handles, and pay the price of KRW 10,000,000 foot installment without molding it within three months, on the face of the week.”

However, there was no intention or ability to pay the price even if the cosmetics were purchased on credit from the victim.

The Defendant, by deceiving the victim as such, received from the victim the 1,00,000 won of the 10,000 won and the 1st class cosmetics, from around that time to September 5, 2012, and received cosmetics equivalent to KRW 5,507,00 in total over 30 times, as shown in the list of crimes in attached Table (1).

2. Around 15:00 on June 4, 2012, the Defendant made a false statement to the victim D at the same place, stating that “The Defendant would make a payment in cash to the victim D, who supplies the cosmetic to the victim and sells the cosmetic to the Domins, to the Domins, to the Domins, and to the Domins, who will receive the payment once a month.”

However, there was no intention or ability to pay the price even if the cosmetics were purchased on credit from the victim.

From June 6, 2012 to August 8, 2012, the Defendant was issued cosmetics worth KRW 9,161,000 in total over 13 times, as shown in the separate list of crimes (2) by deceiving the victim and being supplied 412,00 won to the victim.

3. Around August 9, 2012, the Defendant made a false statement to the victim D, stating that “The Defendant would make a full payment without molding within five days, if he/she lends 1.5 million won of the discharge cost of her money to the victim.”

However, even if the victim borrowed money from the victim, there was no intention or ability to pay the money.

The defendant deceivings the victim to do so.
