1. The defendant shall be the plaintiff.

A. As to each real estate listed in separate sheet 2 through 4, 6 through 13, June 29, 2017

1. Basic facts

A. On June 29, 2017, the Plaintiff’s agent D’s sales contract was concluded between the Plaintiff and the Defendant, and C’s agent, calculated KRW 40,00 per square meter as to the land listed in the attached Table 1 through 13 and the land listed in the attached Table 14 through 17, which is owned by the Defendant and C, and KRW 2,390,440,000 (the sales price of the land owned by the Defendant is KRW 1,331,40,000 among them).

(2) The term “instant sales contract” refers to a sales contract concluded on September 1, 2017 (hereinafter “instant sales contract”) with the remainder of KRW 2,151,396,000 (payment date as of June 29, 2017) and the remainder of KRW 2,151,396,000 (payment date) (hereinafter “instant sales contract”).

A) On June 29, 2017, the Plaintiff concluded a contract deposit with the Defendant and C. (2) On September 12, 2017, the Plaintiff established a company E (hereinafter “E”) in order to construct solar power plants on the land purchased from the Defendant and C, and assumed office as a representative director.

D on September 14, 2017, the representative director of E was appointed on September 14, 2017, and the plaintiff resigned from the office of representative director on the same day, and currently is currently in office as a director.

B. On August 2017, the Plaintiff requested Defendant and C to postpone the remainder payment date of the instant sales contract as of September 20, 2017. On September 4, 2017, the Defendant and C extended the remainder payment date to the Plaintiff on September 4, 2017. However, if the remainder payment is not made until then, the instant sales contract was deemed to have been extinguished due to the Plaintiff’s nonperformance of the contract, and the down payment was not returned. 2) On September 21, 2017, the Plaintiff agreed to postpone the remainder payment date of the instant sales contract again with Defendant and C on September 29, 2017.
