1.The judgment of the first instance shall be modified as follows:

The defendant succeeding intervenor and the defendant shall jointly serve as the plaintiff 19,800.

1. Basic facts

A. The Plaintiff is an insurer who has entered into an automobile insurance contract with A and B (hereinafter “Plaintiff”), and the Defendant is an insurer who has entered into an automobile insurance contract with respect to C, P, P, and the Defendant is an insurer who has entered into an automobile insurance contract with respect to C, P, P, P, and the Defendant’s succeeding intervenor is an insurer whose business was transferred from the Defendant on May 27, 2015 and authorized by the Financial Services Commission.

2. The parties' assertion

가. 원고의 주장 이 사건 사고가 발생할 시점에 원고 차량은 충돌지점으로부터 약 38m 후방에서 시속 110km가량의 속도로 주행 중이었으므로 2차로로 튕겨나간 피해자를 피하여 운전하는 것은 불가능하므로 원고 차량 운전자에게 과실이 있다고 할 수 없다.

Therefore, the defendant is obligated to pay the plaintiff 19,800,000 won and damages for delay.
