1. The Defendant’s KRW 25,00,000 as well as the Plaintiff’s KRW 12% per annum from June 25, 2010 to October 6, 2015.

1. The Plaintiff, on May 25, 2010, lent 25,000,000 won to the Defendant for interest rate of 1% per month and by August 30, 2010. As such, the Defendant is obligated to pay to the Plaintiff interest and delay damages calculated at the rate of 12% per annum, which is the interest rate of the Plaintiff’s interest rate from June 25, 2010 to the date of full payment, and the rate of 20% per annum as stipulated in the Act on Special Cases Concerning the Promotion, etc. of Legal Proceedings, which the Plaintiff seeks, from the next day to the date of full payment.

2. Judgment without holding any pleadings (Article 208 (3) 1 of the Civil Procedure Act);

As the provisions governing statutory interest rates under the main sentence of Article 3(1) of the Act on Special Cases concerning the Promotion, etc. of Legal Proceedings on Partial Dismissals are promulgated on September 25, 2015 and enforced from October 1, 2015, only damages for delay calculated at the rate of 15% per annum from October 7, 2015 to the date of full payment, which is the day following the date of this judgment, shall be recognized and the excess portion shall be dismissed.
