1. Basic facts

A. The Plaintiff is a member of the Cdong Village Association consisting of the residents of Dongcheon-si (hereinafter “village”) with a candidate for the election of the chairperson of the Village Council held on December 15, 2018 (hereinafter “instant election”). The Defendant is the head of the Village Association and the Chairperson of the Election Commission (hereinafter “Chairperson”) on December 15, 2018.

(b) A regular member under Article 4 of the relevant regulations: A regular member shall be elected from among the members of a village council to the head of a household of the office that has been moved-in to the Cdong in Incheon-si.

Article 15 (General Assembly) A general meeting shall be comprised of regular members, and the Chairperson shall preside over it.

The general meetings shall be divided into the general and extraordinary general meetings.

Where a general meeting is to be convened under Article 18, a notice of convening a general meeting shall be sent to regular members not later than seven days prior to the opening of the general meeting, stating the purpose of the meeting, the agenda and date and place of the meeting.

Provided, That when a general meeting is convened again for the same purpose, it shall be notified by the day preceding the opening.

The method of convening under paragraph (1) may be substituted by the transmission of village broadcasting and text messages at least twice.

An election commission shall be established in order to manage the election of executives and the dismissal of village councils under Article 19.

The Chairperson shall be the Chairperson of the Senior Citizens' Council.

Where a vacancy occurs in the president of senior citizens, an auditor shall hold his/her office.

A separate regulations on election management shall be established for the election management.

The provisions on the management of this election shall apply to the election of the village president, head of Tong, and auditor.

A person who intends to be the Chairperson or the head of a Tong shall submit to the Chairperson a signature of at least 10 persons recommended by the prior candidate registration system by no later than 15:00 of the voting day.
