A defendant shall be punished by imprisonment for six months.

피고인은 피해자 C( 여, 15세) 의 친 모인 사람으로, 2017. 1. 13. 00:30 경 삼척시 D에 있는 피고인의 집 안방에서, 피해자가 남자친구인 E을 집으로 데리고 와 함께 생활하고 있고, 피해자의 평소 생활태도 등이 마음에 들지 않는다는 등의 이유로 피해자와 말다툼을 하던 중, 피해자가 피해자의 남자친구인 E과 말다툼하고 있던 피고인의 동거 남인 F에게 “ 아빠도 아닌데 아빠 짓하지 말 아라, 더럽다” 고 소리치는 것에 화가 나, 그곳 안방 TV 앞에 놓여 있던 위험한 물건인 주방용 칼( 전체 길이 약 30cm, 날 길이 약 17cm) 을 가지고 와, 피해자에게 “ (F에게) 사과해 ”라고 말하며 위 칼로 피고인의 배를 긋는 시늉을 하고, 피해자의 목에 칼끝이 닿도록 들이대는 등 피해자를 폭행하였다.
