A defendant shall be punished by imprisonment for not less than one year and six months.
The Defendant: (a) on May 2018, 201 to the applicant G for compensation for KRW 200,000 and the said money.
Reasons
Punishment of the crime
1. On October 9, 2017, the Defendant posted a false statement to the effect that “Around October 9, 2018, the Defendant would transfer money after deducting certain fees from the value of the gift certificates if he/she first sent the number of the cultural gift certificates using the mobile phone Kakao Stockholm to the victim I who visited him/her, by accessing the Internet site to “NAVV Kaf,” and purchasing the cultural gift certificates.”
However, even if the defendant received cultural merchandise coupon pin number from the above victim, he did not think that he would dispose of it to another merchandise coupon purchaser and consume it with his living expenses and Internet gambling funds, and did not have the intent or ability to pay the price for the said cultural merchandise coupon to the victim.
Defendant: (a) deceiving the victim as above; (b) received cultural gift certificates fin numbers equivalent to KRW 197,000 from the victim; and (c) obtained pecuniary profits equivalent to the same amount from the victim via Kakakao Stockholm; and (d) received monetary profits from the victims over 34 times from October 3, 2017 to January 12, 2018 in the same manner as indicated in the attached Table 1, and received monetary profits equivalent to KRW 10,260,000 in total from the victims in the same manner as indicated in the attached Table 1, and received monetary profits from the victims, including gift certificates, fin cards, etc.; and (e) received money from the victims in total from the victims to sell goods, such as fin numbers.
2. On January 10, 2018, the Defendant, “2018 Go-dan 1579,” posted a notice to the effect that the Defendant purchased cultural merchandise coupons by accessing the Internet site “Neber High-Class Kaf,” and then, sent KRW 409,500 in cash to the victim H who visited the Defendant using the mobile phone Kakao Kao Kao Kao Kao Kao Kao Kao Kao Ka to first transmit the 450,000 cultural merchandise coupon number of KRW 40,500,000.
