A defendant shall be punished by imprisonment for life.

A seized knife shall be confiscated.

Punishment of the crime

On February 9, 2013, the Defendant: (a) around 17:00, the Defendant: (b) talked at the Defendant’s inner female house of Jung-gu Seoul Metropolitan Government D apartment 401 Dong 604 to the issue of inter-floor noise with the upper floor of 704 and the personal phone, and (c) talked with the high sex, and (d) talked with 704 square meters.

이에 피고인도 욕을 한 다음, 이를 듣고 피고인에게 대드는 피해자 E에게 “오늘 좀 맞을래 ”라고 말하였는데, 이에 대하여 피해자 E가 “오늘 깽값 벌게 생겼네.”라고 응수하고, 계속하여 “깽값 물어줄 돈은 없으니까 나랑 맞장 뜨자.”라고 말하는 피고인에게 피해자 F가 “오늘 깽값 벌게 생겼네. 아저씨 돈 많이 벌어 놓았나봐. 때려봐! 때려봐!”라고 소리치며 대들자, 피고인은 이에 격분하여 피해자들을 살해하기로 마음먹었다.
