A defendant shall be punished by imprisonment for three years.

Seized evidence 1, 2, 19 through 31 shall be confiscated from the accused.

Punishment of the crime

The Defendant is a person who actually runs G Co., Ltd. (the representative H; hereinafter “multi-level marketing company of this case”), a multi-level marketing company located in Seoul F and 203, and H is a company director of the above company, who is working as a representative director; and I is a managing director, and J is a person who is working as a managing director, and the managing director and the managing director.

The Defendant, from around 2010 to around 2011, was engaged in multi-level marketing in K (one-level L), which is an illegal multi-level company, as a multi-level marketing salesperson. From around 2013, the Defendant changed its trade name to M Co., Ltd. (representative N) and O (representative P) in sequence, etc., and established the multi-level marketing company in the instant case around June 9, 2016.

1. Violation of the Door-to-Door Sales, etc. Act;

가. 무등록 다단계판매조직 운영 행위 피고인은 2016. 6. 경 피고인이 운영하던 불법 다단계업체에서 사용하던 방식을 이용하여 ‘ 고문 ⇒ 이사 ⇒ 대선배 ⇒ 매니저’ 순으로 조직을 구성하고, 수당지급 체계는 1 단계 상위 직급 판매원인 ‘ 매니저’ 가 하위 직급 판매원 매출의 16.5%, 2 단계 상위 직급 판매원인 ‘ 대선배’ 가 하위 직급 판매원 매출의 5.5%, 3 단계 상위 직급 판매원인 ‘ 이사’ 가 하위 직급 판매원 매출의 16%를 후원 수당으로 지급 받는 것을 내용으로 하는 보상 플랜을 수립하였다.

The Defendant: (a) recruited new salespersons to subordinate subordinate workers managed and supervised by H, I, and J; (b) paid support allowances following the above monetary franchise; and (c) took charge of the business affairs related to the instant multi-level marketing company; (b) the Defendant took charge of the business affairs related to the instant multi-level marketing company; (c) the Defendant took charge of the foregoing company’s representative director; (d) the managing director; and (e) the J took charge of the business affairs related to the instant multi-level marketing company; and (e) performed the duties against subordinate salespersons, including organizational management

The defendant requires subordinate salespersons to operate a multi-level marketing organization.
