1. Defendant Press Inc., Ltd., and New Chang Chang Enterprise, Inc., shall be KRW 57,456,467, respectively, to each of the Plaintiff.
Reasons
1. On September 201, the Plaintiff: (a) imported used machines, such as one part of the used special processing machine (NC JJGG, Mitsui, 3gCn, 191) and one part of the special washing machine (Washerher Machine, Oiwa, 1997) in Japan; and (b) requested three containers loaded with the said machine to carry out maritime transportation, import customs clearance, and transportation from Busan to the Plaintiff’s factory.
② As to the three containers loaded and unloaded, Defendant Press Round entrusted the above three containers from the East-gu Busan District Container Terminal to the Yancheon-si, the Plaintiff Company’s factory, to the Yansan-si, Yansan-si, the Plaintiff Company (hereinafter “qar-si”). Moreover, the Plaintiff Company requested the transportation of two containers among them to the Dosung Logistics Co., Ltd., and the Dosung-si, the Defendant New Chang-si, the Defendant Company (hereinafter “Defendant New Chang-si”) entrusted the transportation of one container (TRU052584; hereinafter “instant container”).
③ 피고 신창기업 소속의 운전사 A는 2011. 9. 15. 23:00부터 2011. 9. 16. 02:00경까지 동부부산컨테이너터미널에서 B(변경 후 C) 한특40피트구즈넥콤비샤시 트레일러(이하 ‘이 사건 트레일러’라 한다)에 이 사건 컨테이너를 싣고 위 트레일러를 끄는 D 트랙터 차량(이하 ‘이 사건 차량’이라 한다)을 운전하여 2011. 9. 16. 07:00경 익산시 낭산면 석천리에 있는 원고 회사의 공장에 도착하였다.
④ The height of the instant re-container excluding the fixed device of the instant re-containers is approximately KRW 126.5 cm to 133 cm. The instant container is in the form that no longer covers the instant container with a height of 259 cm. At the time of transportation, the aforementioned used special processing machine protruding about approximately 25 cm to the container.
