Defendant shall be punished by a fine of KRW 3,000,000.

When the defendant does not pay the above fine, 100,000 won.

Punishment of the crime

No one shall resell unregistered real estate purchased for the purpose of evading the imposition of taxes, obtaining profits based on price fluctuation between different market values, or evading restrictions under Acts and subordinate statutes regulating changes in rights, such as ownership.

Nevertheless, the Defendant, without completing the registration of transfer of ownership on the real estate purchased by the Defendant, was exempted from the imposition of taxes by promptly selling it to a third party, was willing to gain profits from price fluctuations between different points of time. On July 5, 2013, the management office of the DA Dong building newly constructed on the land B 107.1 square meters and C 97.2 square meters of land in Sungnam-gu, Sungnam-si, and on the land C 97.2 square meters (hereinafter “instant real estate”), entered into a contract with the joint owner E and F to purchase the said real estate with the sale price of KRW 1.85 million, and did not file an application for registration of transfer of ownership on August 11, 2013, the Defendant entered into a contract with the owner of H 14,36 square meters of land in the name of the Defendant without having the owner of the said real estate transferred on August 12, 2013.
