Reasons
Punishment of the crime
On March 5, 2004, the Defendant received the operational right from F (the Defendant’s relative) which is the founder of the “E Child Care Center” established at Jeju, and continues to hold office as the president of the said Child Care Center until now.
1. No person who operates nursery facilities, such as support for certification and evaluation of nursery facilities, fraud of subsidies and child care centers, shall be granted a subsidy by fraud or other improper means;
On November 19, 201, the Defendant had already purchased and used four block sets as if he were newly purchased, received a subsidy for the evaluation and certification of childcare facilities, and submitted to the Jeju Mayor an application for the subsidy for the certification of childcare facilities, which was falsely prepared as if he had no intention to purchase at 1,210,000 won (subsidies 1,10,000,000 won, and 110,000 won for self-payment) even though he had no intention to purchase at 10,000,000 in the Jeju-do Women's Family and Office.
As a result, the Defendant illegally delivered KRW 1,100,00 of the subsidies for the assessment of child care facilities through the Suhyup Bank Account (G) in the name of the E Child Care Center on September 23, 2011, and at the same time deceiving female families and public officials in charge of the Jeju, thereby deceiving them to receive the aforementioned money from the public officials in charge of the payment.
2. No establisher or operator of a child-care center who illegally receives expenses for special activities shall collect child-care fees, etc. by fraud or other improper means;
The defendant concludes a contract with a special activity enterprise by appropriating the teaching materials and instructors' allowances of the special activity program in addition to the child care program by age according to the standard infant care process in a child care center at a higher level than 21% to 33% of the actual supply price, and falsely notifying the original students of the month to pay the amount appropriated.
