Reasons
1. Basic facts
A. Plaintiff F Co., Ltd. is a corporation established for the purpose of real estate development business, etc. on September 12, 2017; Plaintiff A is a director and representative director; Plaintiff B, C, and E; and Plaintiff D is an auditor; and the Defendant is the owner of each real estate listed in the separate sheet in the separate sheet (hereinafter referred to as “third real estate”).
B. On July 31, 2017, Plaintiff A entered into a contract with the Defendant to purchase KRW 1 through 23, 25, and 26 real estate (hereinafter “first sale contract”) with the Defendant for KRW 2.5 billion (hereinafter “first sale contract”), and determined that KRW 250 million for the intermediate payment of KRW 750 million on the date of the contract and the intermediate payment of KRW 750 million shall be paid on December 30, 2017, and the remainder of KRW 1.5 billion on April 30, 2018.
C. On July 31, 2017, Plaintiff A paid a down payment of KRW 250 million to the Defendant. D.
Plaintiff
A and the Defendant, on September 14, 2017, concluded a new sales contract (hereinafter “second sales contract”) with the Defendant for each of the real estate listed in the separate sheet on the same day between the Plaintiff A, B, D, F, and Nonparty H on the same day:
