A defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. Any foreigner who violates the Immigration Control Act may sojourn in Korea within the limits of his/her sojourn status and period of sojourn;

On March 20, 2012, the Defendant entered the Republic of Korea as a foreigner of Vietnam’s nationality as a seafarer employment (E-10). On June 24, 2013, the Defendant stayed in Kim Sea B without obtaining permission for extension of the period of sojourn even though the period of sojourn expired on April 20, 202.

2. Although the period of stay has expired as stated in paragraph 1, the Defendant, who forged an official document, continued to stay in the Republic of Korea, brought money to bring in the Republic of Korea, and forged an alien registration certificate through the forged business operator to find a company located in the Republic of Korea.

On December 12, 2019, the Defendant requested a forgery of a foreigner registration certificate on the name-free foreigner registration number that he/she became aware of through the advertisement in the name-free foreigner registration number from the Sinju-si, Cheongju-si, and the Defendant sent the Defendant’s photograph, name, address, etc. to the Facebook message and forged the foreigner registration number. Accordingly, the forged business operator forged one foreigner registration certificate under the name of the head of the Gyeonggi Immigration Office on October 15, 201 by means of preparing “the head of the Gyeonggi Immigration Office” and inserting the Defendant’s photograph, name, address, etc. on plastic board in which the size and material of the alien registration certificate is identical and the route for preventing forgery is inserted for forgery: C, gender: Ma, name A, country: VENM, status of stay: Marriage (F-6); and the date of issuance: The business operator forged one foreigner registration certificate under the name of the head of the Gyeonggi Immigration Office on October 15, 2019 by inserting the Defendant’s photograph.

Accordingly, the defendant forged a foreign registration certificate under the name of the head of the Gyeonggi Immigration Office, which is an official document, for the purpose of uttering in collusion with the name-free forgery business operators.
