피고인은 2013. 6. 22. 18:30경 대구 북구 C아파트 101동 1~2호 라인 엘리베이터 안에서, 층간 소음문제로 다툰 적이 있는 피해자 D(36세)을 우연히 엘리베이터 안에서 만나게 되자 순간적으로 화를 참지 못하고 피해자에게 "사람 타는 엘리베이터에 개새끼가 타고 있네, 야 이 개자슥아 내가 너그 애비 뻘이다, 니가 나를 발로 차, 이 개새끼가"라고 욕을 하면서 손바닥으로 피해자의 턱 부위를 2~3회 올려 피해자에게 약 2주간의 치료를 요하는 아래턱 타박상 등을 가하였다.
