The defendant is based on the agreement on April 13, 2010 with respect to shares of 1/4 of each of the real estate stated in the separate sheet to the plaintiffs.
Reasons
1. Facts of recognition;
A. The party’s relationship 1) The real estate listed in the separate sheet (hereinafter collectively referred to as “instant building”) owned by Nonparty D from August 2006 by Nonparty D Co., Ltd. from August 2006
(2) On March 23, 2010, the Plaintiff Company: (a) sold 1/2 shares to Nonparty E; and (b) on April 28, 2010, Plaintiff B served as the manager of the shopping center of the instant building from September 2006 to December 2010; (c) Plaintiff A operated the third floor of the instant building from March 2008 to December 2010.
The Plaintiffs entered into a partnership agreement on December 1, 2008, and from October 201, the hotel was operated on the 5,6, and 7th floor of the instant building.
3) From October 2009, Nonparty F, the representative of the Defendant Company, engaged in photographing business in the 8th wedding hall of the instant building from around October 2009. On January 201, 201, the Defendant Company acquired the instant building shares, the Defendant Company received from the Plaintiff, and has been in possession of the Plaintiff the 3th floor floor of the instant building, and has been operating until now. (b) On June 9, 2008, upon the commencement of voluntary auction with the Daejeon District Court on June 9, 2008, Nonparty F, a representative of the Defendant Company, renounced the successful bid because it did not prepare the auction price, and was subject to forfeiture of KRW 125 million of the auction deposit.
On the other hand, in the above auction case, the lien holder reported on the building of this case and the total amount of the secured claim were about KRW 1.85 billion as follows.
The content and amount of the claim secured by the lien reporting person (won evidence 1), H, and H are only the parties to the contract at the request of the plaintiff A, and are not the actual right holder.
