Reasons
Basic Facts
A. The Defendant Company (hereinafter “Defendant Company”) was a company engaged in gathering and selling earth, sand, and rock, etc., and around 2010, the Defendant (hereinafter “Defendant Company”) ordered dredging to sell it on a selective basis at the G dredging work site located in Chungcheongnam-gun F, Chungcheongnam-gun (hereinafter “instant site”).
Plaintiff
A, who has technical qualifications as a driver of a typer or logr, was employed by the defendant company around June 2010 and served as a driver.
B. The following are the course of dredging, screening, and selling of land on board at the instant site:
If dredging soil is put in a gate, which is located on the upper part of the earth and sand screening machine, the dredging soil is divided into about 3 meters off a consortium, and it is divided into sand and gravel, and if the separated sand is separated from the lower part of it, and where it is visible to move approximately 5 meters from another consortium bell, the above sand is cut off by the dump truck, and the sand is cut off again, and when the weight of sand is measured and the sand price is paid, sand is paid, the sand is taken out and sold on the site of this case.

In addition, at the instant site, H was a maintenance engineer for earth and sand screening machines, but H was mainly engaged in the operation and maintenance of one of the two earth and sand screening machines, and the rest of the earth and sand screening machine (hereinafter referred to as “instant earth and sand screening machine”) was driving and simple repair of the earth and sand screening machine.
Plaintiff
A around 10:40 on December 19, 2012, at the instant site, was under the operation of the instant earth and sand screening machine at a low speed while replacing and running a trial of the instant earth and sand screening machine.
