1. The Defendants trade and sell to the Plaintiff, as of October 27, 2006, the respective share of 9.355/969 in Jongno-gu Seoul Metropolitan Government D major 969m2.
Reasons
1. The following facts may be found either in dispute between the Parties or in full view of each entry in Gap evidence 1 to 5 (including paper numbers), Eul evidence 1 to 9 (including paper numbers), and the entire purport of the pleadings:
The Ework, located outside Jongno-gu Seoul, Jongno-gu No. 504, the original section for exclusive use was 133.95m2, and the F shared shares as shares of 96.02/13.95 and G 37.93/13.95, and divided shares of 37.93m2 among them around February 27, 2001 and divided as 504-1 and divided as G’s sole ownership. However, even after the aforementioned division, the G’s share of 504.02m2 remaining as above was not transferred to F, and even after the aforementioned division, F still still owned as shares of 96.02/13.95 and G 37.93/13.95.95.
B. During that period, F’s rights and F’s share of the land, which is the site, of Nos. 101, 201, 101, 201, 206, 302, 504, and 705, among the above Etawork, was proceeding for compulsory auction at the Seoul District Court H of the Republic of Korea.
B. The Plaintiff (504) and I want to acquire 705 (97.03m2) among the above auction objects. However, when the auction procedure was conducted in the manner of selling the auction objects en bloc, and thus it is impossible to acquire a specific heading room, the Plaintiff, the Defendants, and I acquired the entire object of auction in the name of the Defendants around July 21, 2006, and the Plaintiff paid KRW 150 million to the Defendants. If I paid KRW 200,000,000 to the Defendants, the Defendants transferred to I the rights of 705 and the land annexed thereto to I, and the remaining 6 houses and the land annexed thereto owned by the Defendants each by 1/2 shares, and since the land omitted from the above auction objects is land attached to the auction objects, the ownership transfer is completed in the name of the Plaintiff and I after completing the auction procedure.
