1. The plaintiff's lawsuit against the defendants is dismissed in entirety.
2. The costs of lawsuit shall be borne by the Plaintiff.
Reasons
1. Determination as to the legitimacy of the instant lawsuit
A. As the instant lawsuit, the Plaintiff, as the president of the Dong representative of the instant apartment, held a voting to elect representatives from each building on September 24, 2016 for the formation of the council of occupants' representatives of the instant apartment. In the instant apartment building 202, Defendant B was elected as the representative of each Dong, and Defendant C was elected as the representative of the council of occupants' representatives of the instant apartment complex. However, Defendant C was elected as the representative of each Dong in 201 Dong 3 and April 201. However, the Defendants asserted that it violated the provisions on the election management of the instant apartment in the election of occupants representative of the instant apartment, and sought confirmation of invalidity of the said election resolution against the Defendants.
B. On this issue, the defendants asserted that it is unlawful to seek the invalidity of the resolution of the representative election against an individual who is not the council of occupants' representatives of the apartment in this case because it has no standing to be a party, and therefore, the council of occupants' representatives of the apartment buildings is an unincorporated association consisting of representatives of each building elected in proportion to the number of households of each building. Thus, seeking the invalidity of the resolution of the representative election of each building is ultimately a dispute over the qualification of members of the council of occupants' representatives. Thus, the council of occupants' representatives has the standing to be a defendant in the lawsuit seeking the invalidity confirmation (see Supreme Court Decision 2006Da86597, Sept. 25, 2008) as the actual subject of the dispute over the validity of the resolution, and even if a winning judgment is obtained by filing a lawsuit against the defendants who are the members of the council of occupants' representatives, it cannot be the most effective way to resolve the dispute with the parties surrounding the validity of the above resolution.
