A defendant shall be punished by imprisonment for two years.
However, the execution of the above punishment shall be suspended for three years from the date of the final judgment.
Reasons
Punishment of the crime
1. On December 2007, from around August 30, 2012 to around August 30, 2012, the general building fire Defendant was a person who operated the “Dnosocom Bank” located on the second floor of the Seoul Gwangjin-gu Seoul Special Metropolitan City building C, and around December 28, 2010, the Defendant purchased an insurance policy for the said singing Bank with the amount of KRW 170,000,000 from around December 28, 2010.
Around 2007, the Defendant, who was the Defendant’s possession, received a loan of KRW 200 million in premium of KRW 114,104 and KRW 1804,000 in Seongbuk-gu, Seoul, and operated the said singing room by acquiring KRW 250,000 won in premium of KRW 50,000,000. On August 1, 2010, the deposit remaining after deducting KRW 15,000 in arrears at the time of the renewal of the lease agreement, was merely KRW 35,00,000. On July 2012, the deposit remaining after the Defendant’s payment of KRW 2 million in monthly rent of KRW 15,00 in KRW 350,00 and KRW 2,000 in KRW 7,000 in loan of KRW 30,000 in loan of KRW 7,50,000 in loan of KRW 130,000 in national apartment bank.
In addition, the Defendant was asked from around December 2011 to the building owner F to carry out a singing, and around February 2012, F filed a building name lawsuit against the Defendant and the judgment became final and conclusive around April 23, 2012, and the Defendant was obliged to deliver the said singing from July 31, 2012.
However, when a person who intends to enter into a new lease contract at a singing room operates a door room, not a singing room, he was faced with the situation that the premium and facility costs for a singing room would not be properly collected, the Defendant was willing to receive KRW 170,000,000 from the singing room intentionally, and the Defendant was willing to receive KRW 170,000,000 insurance money.
On July 25, 2012, the Defendant, at around 05:17, was fireed in three above “Dnogate,” and was located therein.
