A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. The defendant is in violation of the Act on Special Cases concerning the Settlement of Traffic Accidents (Bodily Injury).

On July 1, 2016, the Defendant was under the influence of alcohol level 0.234% on blood alcohol level at 0.20% on July 1, 2016, while driving the said cargo vehicle, the Defendant stopped the two-lane road in front of the E-cafeteria located in the Chungcheongnam-gun A, Chungcheongnam-do at the direction of the voice-Eup in one lane and in the middle of one lane on the one side of the voice-Eup apartment.

A driver of a motor vehicle has a duty of care to take the front, rear and left well, and to accurately manipulate the steering and brakes so as to prevent accidents.

Nevertheless, the Defendant was negligent in under the influence of alcohol and was negligent in not operating the brakes properly, which led to the failure of the Defendant to drive the said cargo, and received the part of the victim F (the age of 37) who was standing subsequent to the said cargo, to the left side of the said cargo vehicle.

Ultimately, the Defendant suffered from the injury of the victim F and the victim H (V, 56 years of age) on board the said car due to the occupational negligence as above, for approximately two weeks of medical treatment.

2. The Defendant violated the Road Traffic Act (driving) driving a c-wing 3 truck under the influence of alcohol with 0.234% alcohol level in the section of about 50 meters from the front to the place specified in paragraph 1, one located in the voice of the voice group of North Korea, both at the time and time specified in paragraph 1.
