Reasons
A principal lawsuit and counterclaim shall also be deemed a principal lawsuit and counterclaim.
1. The facts under the recognition of facts may be found either in dispute between the parties or in full view of the purport of the entire pleadings in Gap evidence 1 to 5, Eul evidence 9 and 10 (including branch numbers; hereinafter the same shall apply) and witness D's testimony.
Around August 28, 2015, the Defendant entered into a contract with the Plaintiff under which the Defendant would make an investment in the production and sales business of the Plaintiff and the Plaintiff (hereinafter “instant contract”) with the following content (hereinafter “E”). Under the instant contract, the Defendant paid the Plaintiff the full amount of KRW 220,000,000,000, total of KRW 120,000,000 on July 24, 2015 pursuant to the instant contract.
Article 2 (Definitions of Terms)
2. Direct production costs: The aggregate of costs acknowledged by A (Defendant) as direct costs incurred in planning and producing each of the instant dramas.
3. Investment funds: Investment funds invested by Gap (the defendant) in the planning and production of each of the instant drama under the instant contract.
4. Sales: Sales means all forms of domestic and foreign sales generated in connection with each other, including rights to broadcast and transmission (including all forms of broadcasting, transmission and services), PPL broadcasting and scambling (production support), DVD, video for sale, OST, books, and other publications and printed materials, and the development and sales rights, such as distribution rights, money, travel games, etc., and all forms of intellectual property rights (including neighboring rights, portrait rights, publicity rights, and other commercialization rights, such as rights, etc.) directly or indirectly related to the dramas of this case, such as rights to broadcast and transmission (including all forms of broadcasting, transmission and service), rights to broadcast and sales, and rights to reproduce and sell books, books, and other publications and printed materials.
5. Gross sales: The aggregate amount of sales generated by the sales under the preceding paragraph (excluding taxes and taxes related to the amount of the value-added tax);
