Defendant
A shall be punished by imprisonment with prison labor for five months and by imprisonment for eight months, respectively.
Reasons
Punishment of the crime
1. On June 13, 2013, Defendant B and D’s fraud D related to traffic accident: (a) around 09:45, Jun. 13, 2013, Defendant B, while driving a F motor device owned by E on the street in front of the Chungcheongbuk-gu, Chungcheongnam-gu, Chungcheongnam-gu; (b) was driving by Defendant B while driving the bicycle in front of the signal waiting.
H Engine bicycle parts were received from the back of the H Engine bicycle, and the J Engine was driven by the I while going beyond the H Engine bicycle, which was in the signal waiting in the side.
D After having paid a traffic accident as above, D carries a bicycle bicycle driver's license as if the motor device has no motor device and bicycle driver's license. On the same day, Cheongju Co., Ltd. received the insurance in the victim LIG non-life insurance company in the name of K, and Defendant B, G, and E knew that D would receive the insurance in the name of K.
Accordingly, Defendant B received from the victim company KRW 500,00 on June 13, 2015, KRW 1,430,000 on June 27, 2015, and KRW 500,030 on June 13, 2015, KRW 42,860 on June 14, 2015, KRW 480,00 on June 17, 2015, and KRW 650,000 on June 17, 2015, respectively.
Accordingly, the defendant B, in collusion with D, G, and E, obtained pecuniary benefits by deceiving the victim company.
2. On May 11, 2014, Defendant A and B expressed their intent to claim and receive insurance money after intentionally paying the traffic accident with L, along with Defendant A and B related to the traffic accident.
Defendant
A and B, around 18:05 on May 11, 2014, on the street in front of the N cafeteria cafeteria located in the Heak-gu Cheongju City, Chungcheongnam-gu, the Defendant A and L find that Q Ma business car driven by P while boarding the said car is being driven in the central line, and intentionally, they find that the said M ran car driven by P is driven in the middle line at the Cheongju-si on the same day after he intentionally received the traffic accident and paid the traffic accident.
