In addition, all appeals filed by both medical care and custody applicants and prosecutor are dismissed.
Reasons
1. The summary of the grounds for appeal (one year of imprisonment) of the lower court is too heavy or (the defendant and the person in charge of the treatment and custody (hereinafter “the defendant”) and the person in charge of the treatment and custody (the prosecutor) are too unhued.
2. Determination
A. The Defendant’s crime committed on the part of the instant case is an unfavorable circumstance to the Defendant, such as the following: (a) the content of the crime is anti-humanistice; (b) the manual is very cruel; and (c) the victim seems to have suffered damage several times from the Defendant even before the instant case was rendered; and (d) even if the Defendant had been faithfully protected and supported by the Defendant, it appears that the victim would have suffered very severe physical or mental pain due to the instant damage.
On the other hand, it seems that the defendant was suffering from the current symptoms due to shock by father's suicide, etc. which occurred before about twenty (20) years prior to his school in his school, and that the defendant was unable to lead a normal life, such as being hospitalized and receiving outpatients from time to time, and that he could be the major cause of preventing the defendant from committing the crime of this case. The defendant cannot be held liable for all of his responsibility only to the defendant (if the defendant is hospitalized at a hospital, the victim's visit the hospital and reported the defendant to the hospital, and the treatment for the defendant is not well performed).
