A defendant shall be punished by imprisonment for not less than two years and six months.

Punishment of the crime

[Criminal Justice] On March 18, 2011, the Defendant was sentenced to one year of imprisonment for a crime of fraud at the Goyang Branch of the Jung-gu District Court on March 18, 201, and the said judgment became final and conclusive on December 27, 2011.

【Criminal Facts】

1. On April 2007, the Defendant against the victim C and D made a false statement to the effect that “The Defendant, at the F Company’s office located in the fiveth floor of the building in Gangnam-gu Seoul, Seoul, would have been running a hotel, swimming pool, and casino development project on a private board, and that the permission was completed. The Defendant would be 2.5% interest of 2.5% per month if he/she lends money to the development fund, and he/she would be able to pay money within three to four months. In addition, the Defendant made a false statement to the effect that “There is a collateral mortgage worth KRW 1.5 billion on the land owned by his/her father, but the remaining collateral value is sufficient.”

However, the defendant, at the time, bears excessive obligations, such as lending and using approximately KRW 1 billion bonds with his father G-owned land as security, while there was no property or income, and there was no ability to proceed with the development project of the above-mentioned hotel and the inducement of funds.

The Defendant received KRW 4885 million from the victim C on May 10, 2007, and KRW 977 million from the victim D on the same day before the said Defendant’s horses were transferred from the victim C as the borrowed money, respectively.

Accordingly, the defendant was given property by deceiving the victim C and D.

2. Fraud against victim H;

가. 피고인은 2010. 3. 하순경 고양시 일산동구 장항동에 있는 상호를 알 수 없는 맥줏집 등에서 피해자 H에게 "사이판에 호텔과 카지노 개발사업을 진행 중이고, 롯데건설과 1,000억 원 정도의 시행 계약을 체결할 예정이다.

If a victim's land is provided as security and a loan of KRW 200 million is provided, the victim shall be repaid within one month, and interest on the loan shall be paid, and the amount of KRW 1 billion shall be paid if he/she receives profits from the market. If he/she fails to repay money within one month, the victim shall be paid.
