Facts of recognition
Since November 14, 2002, the sectional owners of Wlue Building (hereinafter “instant destroyed building”) located on the ground of Gangnam-gu Seoul Gangnam-gu land agreed to remove the instant destroyed building and reconstruct the building on that ground (hereinafter “instant reconstruction building”) and delegate the reconstruction affairs to the Plaintiff.
The Plaintiff and the sectional owners of the destroyed building of this case concluded an agreement with the Plaintiff that the sectional owners of the destroyed building of this case “any sectional owners who wish to re-enter the building of this case among sectional owners shall enter into the same agreement with the Plaintiff, and any persons who do not want to re-enter the building of this case shall sell the sectional ownership right
Since then, with the consent of all sectional owners of the destroyed building of this case, the plaintiff removed the destroyed building of this case from March 1, 2006 to March 31, 2006, and newly constructed a main complex building of three underground and six underground floors on the land.
However, the plaintiff failed to obtain some of the shares in the above land from November 2008 to December 2009, and the defendant B, F, etc. applied for provisional injunction against disposal of each unit of the reconstruction building of this case to the Seoul Central District Court from November 2008 to December 2, 2009, and the registration of preservation of ownership in the name of X,Y, Y, Z, AAB, AC, AE, AE, AE, AF, AF, AH, AH, AJ, AJ, AJ, AK, AK, AL, AM, B, C, and F as to each unit of the reconstruction building of this case, and the registration of preservation of ownership in the name of each unit of the attached list of the real estate of this case as shown in the attached list is completed at the time of the entrustment of provisional injunction registration by the above court. The real estate and the shares of the owner of the provisional attachment disposition has been completed.
