1. The Defendant’s KRW 2,716,579 as well as the Plaintiff’s KRW 6% per annum from April 21, 2014 to May 17, 2018, and the following.
Reasons
1. Basic facts
A. The Plaintiff is a company that conducts marine environmental management business (oil hold cleaning business and marine pollution response business), and the Defendant is a company that manufactures, exports, and imports petroleum and petrochemicals.
B. At around 09:35, January 31, 2014, when C, a Singapore’s nationality, loaded crude oil purchased by the Defendant and attempted to contact with the Defendant’s DB, a tugboat controlled and managed by the Defendant, the occurrence of an accident involving the leakage of crude oil, oily mixtures, etc., resulting in the destruction of facilities and oil pipelines by taking facilities and oil pipelines through excessive speed and safety measures, etc., due to the destruction of oil, oily mixtures, etc. into the sea (hereinafter “instant outflow accident”).
C. The Plaintiff, upon receiving a request from the Korea Coast Guard (hereinafter “Maritime Police Agency”) for pest control operations due to the instant outflow, performed the Plaintiff’s operations, such as coastal pest control operations and repair, etc. of coastal pest control equipment (hereinafter “instant pest control operations”). From February 3, 2014 to April 18, 2014, the Plaintiff was assigned to the Plaintiff from February 3, 2014 (such as the Gumi, Fuchi, mari, magsan, U.S.), to the area of pest control operations (hereinafter “instant pest control operations”).
