1. As to KRW 3,282,390,386 and the Plaintiff’s KRW 101,00,000 among the costs, Defendant Mucom Co., Ltd., Apr. 2, 2013.
Reasons
1. Basic facts
A. At around 2010, Nonparty Co., Ltd. (hereinafter “instant building”) implemented the construction project of the main complex building under the name of Nonparty Co., Ltd. (hereinafter “instant building”) with the 80th above ground and the 5th above ground level on the land of Busan Shipping Daegu Do-1407, Busan, and the 1407 Do-1407.
In the same year, the above company selected Nonparty 2 Construction Co., Ltd. (hereinafter “dusan Construction”) as the contractor and entered into a contract for construction works of the building of this case with the two industries construction.
B. On October 7, 2010, 2010, two mountain construction concluded a construction contract with the Plaintiff to subcontract the part of painting construction among the new construction works of the instant building. On October 7, 2010, the Plaintiff entered into a contract with the Defendant penttech Co., Ltd. (hereinafter “Defendant penttech”) to re-subcontract the part of painting construction of the first or fifth floor of the above painting construction cost (including additional tax) as of January 31, 2012 from the date of the said contract for the construction period to January 31, 2012 (hereinafter “instant floor construction contract”).
C. Around December 201, Defendant pentke completed the floor painting construction work on the floor surface of the first and fifth floors underground among the instant buildings.
In executing the above floor painting construction, Defendant pent-C321, which was produced by Defendant C-C321 Co., Ltd. (hereinafter “Defendant C-C-C-321”) and procured from the company, used as materials for painting construction a fire-proof paint of inorganic in the name of the model (hereinafter “instant fire-proof paint”).
However, around August 201, among the instant buildings, there was a defect in the ero-friendly and eco-friendly phenomenon and eco-friendliness from the entire floor of the 2nd and the 5th underground floors (hereinafter “the eco-friendly structure”).
