A defendant shall be punished by imprisonment for one year and suspension of qualifications for a year.

However, the above imprisonment for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

Although the defendant and the victim B stated that the facts charged in relation to the relation between the defendant and the victim B living together are "a de facto marital relationship", the Daegu Family Court decided on May 13, 2020 that "it is insufficient to view that the defendant and the victim were in a de facto marital relationship beyond a certain period of living with the defendant and the victim," in the case of claiming consolation money following an unfair destruction of a de facto marital relationship

(The Daegu Family Court 2019ddan113149) Accordingly, the relationship between the defendant and the victim shall be corrected and determined as "the relationship between the defendant and the victim"

No person shall censorship any mail, wiretapping any telecommunications, provide communication confirmation data, record or listen to any conversations between others that are not open to the public without going through the Protection of Communications Secrets Act, the Criminal Procedure Act or the Military Court Act.

Nevertheless, the Defendant: (a) on June 18, 2019, on the premise that he/she would secure the evidence of bad wheels of the victim B; (b) on the premise that he/she had a tape recorder installed in the second floor C2 living room in Chungcheongnam-gun, the victim was living, and recorded the conversations between the victim B and D, and the victim B and E, etc. from around that time until June 24, 2019.

For the purpose of securing evidence necessary for civil litigation in progress with the victim B, the Defendant recorded the contents of telephone conversations with the victim G by opening the window using the Defendant’s cell phone from the outside of the residence of the victim B located in the Gyeongbuk-gun on August 15, 2019.

The defendant recorded a conversation between others that is not open to the public.
