1. The Defendant’s KRW 5,00,000 as well as the Plaintiff’s annual rate of KRW 5% from January 6, 2017 to September 18, 2019.

In full view of the purport of the entire arguments in Gap evidence Nos. 1 through 7 (including paper numbers), the defendant shall take into account the purport of the whole pleadings from C on April 16, 2013; KRW 30 million on April 16, 2013; KRW 15 million on April 18, 201; and

6. 22. 3 million won, and the same year;

8. The Defendant borrowed KRW 12 million on August 20, 2013. The Defendant: (a) borrowed and kept a loan of KRW 60 million from C; (b) paid KRW 50 million to the Defendant on behalf of the Defendant for the use of a loan; (c) the cash custody certificate (Evidence 1) stating that “if there is any remainder, it will be returned to C”; and (d) the contract with E and F in the construction site executed by C shall be entered into with the Defendant; (d) the amount of the loan of KRW 55 million and KRW 5 million shall be put to the said site; and (e) the fact that the Defendant notified the Defendant of the payment of the loan of KRW 5 million to the Defendant on behalf of C; and (e) paid KRW 5 million to the Defendant on behalf of the Defendant on January 25, 2017; and (e) the Defendant did not transfer the loan to the Defendant on May 15, 2017.

According to the above facts of recognition, the Defendant is obligated to pay to the Plaintiff the amount of KRW 55 million and the damages for delay calculated at the rate of 5% per annum prescribed by the Civil Act from January 6, 2017 to September 18, 2019, the delivery date of a copy of the complaint in this case, and 12% per annum prescribed by the Act on Special Cases concerning the Promotion, etc. of Legal Proceedings, from the next day to the day of full payment.

As to this, the defendant, on behalf of the plaintiff, agreed to pay the ready-mixed price to E (H), and as such, between C and the defendant as the transferee of the bonds, the plaintiff and the defendant.
