A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

[criminal history] The Defendant was issued a summary order of KRW 3 million for a crime of violating the Road Traffic Act at the Cheongju District Court Support on May 29, 2014. On November 23, 2015, the Defendant had a record of violating the prohibition of drinking alcohol driving regulations at least twice by receiving a summary order of KRW 2.5 million for a crime of violating the Road Traffic Act (driving) in the same court.

[Criminal facts] The Defendant is a person engaging in driving a B car.

피고인은 2018. 6. 3. 19:10 경 혈 중 알콜 농도 0.210% 의 술에 취한 상태로 자동차 운전면허를 받지 아니하고 위 승용차를 운전하여 단양군 매포읍 하 괴리 산 21-11에 있는 삼 봉 2 터널 앞 편도 2 차선의 도로를 별곡 사거리 방면에서 성신 양회 방면으로 2 차로를 따라 시속 미상의 속력으로 진행하던 중, 위와 같이 술에 취해 전방 및 좌우를 제대로 주시하지 않고 조향 및 제동장치를 정확히 조작하지 아니한 업무상 과실로 위 카 이런 승용차 진행방향 우측에 설치되어 있는 경계석을 들이받고 튕겨 나오며 마침 위 카 이런 승용차 뒤 쪽에서 1 차로를 따라 진행하던 피해자 C(22 세) 운전의 액 티 언 스포츠 화물차 조수석 쪽 앞 범퍼 부분을 위 카 이런 승용차 조수석 쪽 문짝 부분으로 들이받았다.

As a result, the Defendant suffered multiple ties in need of approximately two weeks of medical treatment due to the above occupational negligence.
