A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. The Defendant in violation of the Building Act is the actual owner of each building (public notice source) located in Young-gu, Young-gu, Young-gu, Suwon-si, and Young-si, and the Defendant obtained a construction permit from the Suwon-si, on April 22, 2011, for the F building (public notice source, 9 stories on the ground, and 90.15§³ on the total floor area) in Suwon-si, and obtained approval for use on March 2, 2012. G buildings (public notice source, 6 stories on the ground, 1,043С on the ground, 1,043С on April 22, 201, with a construction permit granted from the Suwon-si, and H buildings (public notice source, 7 stories on the ground, and 952С on the ground of the total floor area) upon obtaining a construction permit granted from the viewing on April 22, 2011, and obtained approval for use on March 2, 2012.

In order to change the purpose of use and make a large-scale repair of a building for which approval for use has been obtained from the competent authorities, the defendant obtained approval for the use of the above three buildings without filing a report with the competent authorities, and around that time, the defendant changed the use of the general residential facilities with independent residential form by changing the purpose of use of the common residential facilities (total 18 rooms) installed on each floor of the guest rooms (total 86 rooms) into the announcement room.

2. Construction works for residential buildings the total floor area of which exceeds 661m2, or other buildings the total floor area of which exceeds 495m2 shall be executed by a constructor;

Nevertheless, as in paragraph (1), the Defendant reported the commencement of construction as if he were to construct a publicly announced source building with a total floor area of 900.15 square meters, 1,043.37 square meters, 1,043.37 square meters, and thereafter, the Defendant, other than the constructor, employed the father and carried out construction work.

Accordingly, the Defendant, in violation of the restriction of the contractor of construction works, executed each of the above notification sources.
