Punishment of the crime
Defendant
B purchased Maker cards (hereinafter “the special card of this case”) indicating the type of the card, and sirens (hereinafter “the special siren of this case”) that can read, as the Maker cards were used for gambling with the victim D, victim E, victim F, etc., and the Maker cards (hereinafter “the special siren of this case”).
1. On June 8, 2012, from around 20:00 to 23:00 on the same day, Defendant B’s sole criminal conduct replaced the card used by the victims with the special card of this case, using both snows in Ansan-si, and then confirmed the type of the card through the special siren of this case, distributed the card of this case to the victims and the participants, distributed approximately KRW 5,000 to approximately KRW 4,00, and carried the card exchange and the amount of betting in three times, and then, a farite was carried on several occasions by a person who confirmed a small number of betting tickets.
As such, the defendant, by deceiving the victims, attempted to take money from the victims, but did not achieve the objective of the money, but did not commit an attempted crime.
2. Defendants B used the instant special sirens and the instant special card to Defendant A, a middle school alumni, and offered a proposal to see any defect in gambling with the victims. Defendant A responded to this and agreed that the Do money acquired was in conflict with Defendant B.
Accordingly, between June 21, 2012 and 23:30 on the same day, the Defendants: (a) replaced the card used by the victims with the special card of this case by wearing both snows of the special sirens of this case; (b) confirmed the type of card through the special siren of this case; and (c) confirmed the type of card through the special siren of this case; and (d) together with the victims during several times of gambling.
