However, as to Defendant A, this shall not apply.

Punishment of the crime
Defendant
A from January 23, 2013 to June 26, 2013, the F station located in both States E was operated. Defendants B, C, and D are those who jointly operate the F station from June 26, 2013 to June 26, 2013.
The Defendants, on the basis of the fact that the fuel subsidy is paid, paid to the cargo vehicle engineers a larger amount of money than the actual week, using the cargo driver welfare card, provided the cargo vehicle engineers with approximately 10% of the difference after deducting 10% of the difference, and had the cargo vehicle engineers pay the fuel subsidy falsely so that the cargo vehicle workers can receive the fuel subsidy from their own jurisdiction.
1. Defendant A
A. On February 3, 2013, the Defendant committed the crime of fraud: (a) around 15:34, 2013, paid KRW 39,00 via H vehicles to the cargo driver welfare card in the name of the above G that received the fuel subsidy; (b) paid KRW 139,000 in cash; and (c) paid KRW 100,000 in excess of the difference; and (d) granted the fuel subsidy of KRW 139,00 in cash from the time of the subscription government that received the fuel subsidy by G to receive the fuel subsidy of KRW 31,970.
As such, the Defendant: (a) by deceiving the victim’s Government Time from February 3, 2013 to February 26, 2013, ordered the said victim to receive the paid subsidies of KRW 606,970 for KRW 2,639,00 that was falsely paid to said G on 12 occasions; (b) and (c) as indicated in attached Table 1, 40 persons, such as G, etc., received KRW 17,797,65 in total of the paid subsidies for KRW 77,381,150 that were falsely paid over 218 times.
(b) No person committing a crime of violating the Specialized Credit Financial Business Act shall lend money by making a credit card transaction in order to pretend the sale of goods or provision of services, etc. or in excess of the actual sales
Nevertheless, the Defendant is operating a cargo driver G at the same time and place as described in the foregoing paragraph (a).
