Reasons
Basic Facts
Of each of the instant lands in the G name and each of the lands listed in the separate sheet for disappearance of G (hereinafter “each of the instant lands,” and each of the instant lands is indicated in the same manner as “instant land” according to the sequences, the ownership transfer registration was filed in the Plaintiff’s father G on March 23, 1948 with respect to each of the instant lands, and on March 3, 1948 with respect to each of the instant lands, the Plaintiff’s father G on March 3, 1948.
G was missing after September 1, 1950, and the Daejeon District Court 2009B38, Jun. 1, 2010, issued a decision to declare the disappearance on September 30, 1955. The decision to declare the disappearance became final and conclusive on July 13, 2010.
At the time of the expiration of the above period of disappearance, the mother of G was H (the deceased on January 29, 1979), I (the G on February 5, 1960), her wife (the deceased on February 5, 1960), but the divorce invalidation judgment became final and conclusive on July 14, 2010, and died on July 26, 1990), and there was Plaintiff as her father.
On September 12, 1964, with respect to the land Nos. 1 through 6 of this case changed by the owner of the land of this case, the registration of ownership transfer was made on June 16, 1964 between J and G under the name of J on September 12, 1964.
Among them, with respect to the land Nos. 1, 2, 3, and 6 of this case, the ownership transfer registration was made in the name of K on April 14, 1967, and in the name of L on December 28, 1972, the ownership transfer registration was made in the name of L and the Republic of Korea on November 21, 1973.
In addition, with respect to the land Nos. 4 and 5 of this case, on April 14, 1967, the ownership transfer registration was made under the name of K and the Republic of Korea on August 6, 1971.
Since the Republic of Korea launched and occupied the land Nos. 1 through 6 of this case on July 20, 1962, it has used it as a site for MV until now.
As to the land No. 7 of this case changed by the owner of the land of this case, sale on April 14, 1967 between N and G in the name of N on April 12, 1967.
