1. The plaintiff's claim is dismissed.
2. Of the costs of lawsuit, the part pertaining to the participation of the Plaintiff’s Intervenor is as follows.

1. Basic facts

(3) The transfer of ownership is registered simultaneously with the payment of any balance.
3. The terms of this contract shall enter into force on the date of preparation of the contract by the buyer as the deposit or direct payment to the seller of the pre-sale agreement in the account.
Article 12 [Cancellation, etc. of Contracts] (1) In cases where a buyer fails to perform his/her obligation as determined by this contract, the seller may rescind this contract, and in such cases, the seller shall vest the purchase and sale reservation agreement and the balance of the down payment in penalty in the seller.
(2) If the seller fails to perform any of his/her obligations prescribed in this contract, the buyer may rescind the contract, and in such cases the buyer shall cancel the contract.
